DUI PENALTIES (NS)

Charges of blood alcohol in excess of .08 or impaired driving


In Nova Scotia, upon arrest and being charged:


Seizure of motor vehicle


90 day suspension of drivers license.


CAUTION : At end of the 90 days, restoration of license is not automatic.  


Must first pay $350.00 to Service NS, and

complete an addiction treatment program.



Upon a first conviction:


License revocation for 1 year - Motor Vehicle Act


Canada wide driving prohibition for 1 year (minimum) - Criminal Code


Minimum fine of $1,000.00 - Criminal Code


Victim fine surcharge of 15% of the fine and court costs


Criminal record


CAUTION  If the license has been restored during the court process, the 1 year license revocation and driving prohibition will commence on the date of conviction. No credit is granted for pre conviction suspension.


CAUTION : At end of the 12 months, restoration of license is not automatic.

complete the addiction treatment program.
